  • The wage offered to the foreign worker must be consistent with the prevailing wage for the occupation in the region where the job is located.
  • Employers must prove that their business is legitimate and financially stable.
  • Employers must be in compliance with all federal and provincial/territorial employment laws and regulations.
  • Employers are required to pay a non-refundable employer compliance fee for each LMIA application.
  • Employers should not have laid off or reduced the hours of Canadian workers in the same occupation and location as the job for which the LMIA is being requested.
  • Employers must agree to on-site inspections and audits by ESDC to ensure compliance with the terms of the LMIA and the Temporary Foreign Worker Program.
